K.S.A. 45-215 et seq.

It is the official policy of the Office of the State Fire Marshal (OSFM) that public records maintained by the OSFM be accessible to the public in accordance with the Kansas Open Records Act (KORA), K.S.A. 45-215, et seq. Access to public records that do not fall within an exception to KORA will be provided timely, with due regard for preserving the records maintained by the agency and preventing excessive disruption of the agency’s essential functions.

Members of the public seeking compiled contact information for the individuals or entities that are licensed or registered under our office, are required to submit to the Office of the State Fire Marshal a request for such information pursuant to the Kansas Open Records Act.

KSA 45-220 states that it is unlawful to: (A) Use any list of names or addresses contained in or derived from the records or information for the purpose of selling or offering for sale any property or service to any person listed or to any person who resides at any address listed; or (B) sell, give or otherwise make available to any person any list of names or addresses contained in or derived from the records or information for the purpose of allowing that person to sell or offer for sale any property or service to any person listed or to any person who resides at any address listed.

The unlawful use of lists of names and addresses may result in a civil penalty of up to $500, pursuant to KSA 45-230.
